SECTION 1 – ONLINE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province of residence or state and give consent to allow any of your minor dependents to use this site and internet service.
You or your dependents may not use our products for any illegal or unauthorized purpose nor may you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You or your dependents must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 – GENERAL CONDITIONS
ESIS is an incorporated not-for-profit internet society formed with the goal of bringing affordable and reliable high-speed internet service to Crawford Bay and surrounding central Kootenay Lake communities.
You must be a member of the East Shore Internet Society (ESIS) in good standing. The East Shore Internet Society is a small community operated Non-Profit Internet Service Provider (ISP) intended solely for the benefit of its members. As ESIS’ internet service is a shared system, we stress that internet users show respect to other users on the system by not leaving high-bandwidth programs running when you are not using those programs (e.g.: torrents, Netflix). This will help to ensure that all ESIS internet users can have an internet connection at reasonable speed.
East Shore Internet Society will provide you or your business with end-user equipment for the purpose of connecting to our Internet Service. ESIS owns wireless equipment that will be installed on your property, and retains the right to remove this equipment when we no longer provide you with internet service. The equipment will be selected by us at the time of the installation based on your home or business needs and we reserve the right to upgrade, change or remove our equipment. The equipment will consist of one Customer Premises Equipment (CPE), and the device(s) necessary to power the CPE. The applicable charges for the CPE and installation costs for the Internet Service are identified at the time the Service is ordered.
You must pay for your ESIS annual membership, estimated installation fee, and a refundable security deposit equal to one month at your package rate prior to having your installation appointment scheduled by one of our technicians.
A wireless router is required to connect wireless devices to our internet service and a selection of routers are available for purchase. Please note that once the router is installed and working, you are responsible for the router’s ongoing maintenance.
We reserve the right to refuse service to anyone, for any reason, at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact or content on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
Although we regularly update or amend the information on our website, at any time the information may not be accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary sources for accurate, complete or timely information. Any reliance on the material on this site is at your own risk.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our offices or online. Examples of prohibited servers and services include, but are not limited to mail, http, ftp, irc, dhcp servers, and multi-user interactive forums.

In no case shall EAST SHORE INTERNET SOCIETY, our directors, officers, employees, members, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 14 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless EAST SHORE INTERNET SOCIETY and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 – SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 – OVERDUE ACCOUNTS
For unpaid accounts 30 days past invoice date (accounts deemed overdue), the EAST SHORE INTERNET SOCIETY reserves the right to charge a penalty at the rate 21% per year calculated as: number of days past due multiplied by the balance outstanding multiplied by 21% divided by 365. The finance charge will be applied to the outstanding balance on the monthly billing date. Should the Service be disconnected, a reconnection fee of $30.00 plus tax will be charged and the balance owing is to be paid in full before reconnection can be initiated.
SECTION 17 – TERMINATION OF AGREEMENT
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 18 – REFUND POLICY
Return & Refund Policy: If you are not entirely satisfied with your purchase, we can address your concerns as follows:
Product Returns – You have 30 calendar days to return an item from the date you received it. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging. Your item needs to have the receipt or proof of purchase.
Refunds – Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspecting the item. If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within 30 days, depending on your card issuer’s policies.
Shipping – You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are nonrefundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
No refunds are available on internet services. It is your responsibility to ensure that your service package is the correct one over the full course of a billing period.

SECTION 19 – ENTIRE AGREEMENT
